Manifest Failure of US CRAs

The manifest failure of self-regulatory efforts, both formal and informal, to ensure high standards of independence, integrity and professional diligence relates not the European rating agencies, claims Feri EuroRating Services AG in Bad Homburg, Germany, near Frankfurt am Main (www.feri.de). „In our view only to some parts of the rating industry, namely to the US CRAs rating structured finance instruments. Our main objective is and always was to ensure that ratings are reliable and accurate pieces of information.“
Feri EuroRating Services gives utmost importance to mitigate any negative influence on the ratings resulting from conflicts of interest within their organization. „We follow highest standards of quality in the ratings and take nearly all measures to assure transparency of our agency.“
The European Commission had published on 31 July 2008 two consultation documents on CRAs seeking views from all interested parties by 5th September. The first document relates to the conditions for the authorisation, operation and supervision of credit rating agencies. The second proposes policy options in order to tackle what is felt to be an excessive reliance on ratings in EU legislation. In their answer, Feri EuroRating Services writes, „we share all objectives of your proposal, to ensure that CRAs avoid and manage appropriately any conflict of interest, to ensure that CRAs apply a high standard for the quality of the rating methodology and the ratings, and to increase the transparency of the CRAs.“
„We would highly appreciate if all CRAs would become as transparent as our organization“, says Dr. Helmut Knepel, board member of the rating agency. Since Feri assumes to meet the objectives of the Directive / Regulation in their daily work already, they believe additional compliance costs will be limited.
With respect to the excessive reliance on ratings in EU legislation, Feri sees little room to stay lax on rating agencies. „We see little alternative to a better regulation of the recognition process for rating agencies. It would not be appropriate to leave this field to the US lawmakers.“ The Credit Rating Agency Reform Act of 2006 requires applicant CRAs e. g. provide written certifications of not less than 10 qualified institutional buyers from the US. „There is no point in making European rating agencies meet this US requirement“, says the German-based rating agency. „Therefore European lawmakers will have to bring a similar law into force if European rating agency shall be given any chance to establish themselves with a European customer base.“

Werkstattbericht zu Ratingmethoden

Dr. Peter König, Geschäftsführer der DVFA GmbH in Dreieich (www.dvfa.de), wundert sich in seiner Einführung zu einer Veranstaltung „DVFA-Club“ in Frankfurt am Main über die oft geäußerte Meinung, Rating sei etwas „ganz anderes“ als Finanzanalyse. Die krisenhafte Entwicklung, die die Finanzmärkte im letzten Jahr prägte, widerspricht dieser Sichtweise, unterstreicht König. Methoden der Finanzanalyse und des Ratings haben viel gemeinsam.
Prof. Dr. Jens Leker, Direktor des Instituts für betriebswirtschaftiches Management im Fachbereich Chemie und Pharmazie an der Westfälischen Wilhelms-Universität Münster gibt im DVFA-Club in Frankfurt am Main einen Überblick über aktuelle Entwicklungen. Trennschärfe und Kalibrierung seien die wichtigsten Dimensionen zur Beurteilung eines Ratingsystems. Die Güte der Probability of Default-Prognose könne anhand der Power-Kurve, der Korrelation, aber auch durch die mittlere Abweichung der beobachteten Ausfallrate von ihrem Mittelwert analysiert werden. Leker erläutert die typischen Gütekriterien eines Ratingsystems.
Wenn fehlende Werte durch Mediane ersetzt werden, statt weggelassen werden, hat dies unterschiedliche Konsequenzen für Trainings- und Test-Sample, gibt Leker ein Beispiel. Wenn kleine Unternehmen (Umsatz unter 5 Mio. Euro) ausgeschlossen werden, werden die Klassifizierungsergebnisse in der Teststichprobe besser. Leker zeigt die Konfidenzintervalle beobachteter Ausfallraten: Das Konfidenzintervall habe im Investment Grade eine ganz andere Bedeutung als im Speculative Grade. Die Schwierigkeit liege darin, gerade die guten Bonitäten mit Hilfe eines solchen Systems verlässlich einzustufen.
Bei der Schätzung mehrjähriger Ausfallwahrscheinlichkeiten zeige sich die Transition. Bei den guten Bonitäten seien die Bilanzratingverfahren weniger aussagefähig. Leker weist darauf hin, dass eine viel größere Zahl von Unternehmen statistisch erfasst werden müssten, um verlässliche Methoden auch für die besten Ratings zu entwickeln: Ohne eine sehr große Stichprobe können Ausfallwahrscheinlichkeiten im Promillebereich kaum modelliert werden. Die Entwicklung und Beurteilung von Ratingsystemen sollte immer Klassifikation und PD-Prognosen berücksichtigen. Die Ergebnisse werden stark durch die Vorgehensweise in der Aufbereitung der Trainingsdaten beeinflusst.
Frank Cerveny, ABS & Structured Credit Research der DZ Bank, erläutert, warum die Diskussion um die Ratingagenturen mit der gegebenen Schärfe geführt werde. Zugleich will Cerveny die Rolle der Ratingagenturen als Sündenbock relativieren. „Pleiten, Pech und Pannen“, „Kühe, Kartenhäuser und Burnout“, so und weitere Zitate lassen sich den Medien entnehmen. Cerveny sieht eine Reihe von Problemen: Überhastet zusammengebaute Modelle, Strukturierer, die Risiken verbergen wollten, Agenturen, die das Ratinggeschäft „mitnehmen“ wollten – nach dem Motto „nach mir die Sintflut“ -, müsse vor dem Hintergrund gesehen werden, dass diese oft mit einer 60 Stundenwoche konfrontiert seien.
Welches sind die guten Segmente? Bei den Subprime-bezogenen Wertpapieren wurden die Bonitätsverschlechterungen unterschätzt – Schieflagen von Hedgefonds wurden getriggert und in der Folge Kettenreaktionen ausgelöst. Die Herabstufungsquoten lagen teils jenseits von 80 %, was die schlimmsten Erwartungen von Investoren übertraf, zeigt Cerveny.
Manche Produkte hätten vielleicht erst gar nicht von den Agenturen geratet werden sollen, da diese mehr von Marktpreisrisiken abhängig waren. „Schritt für Schritt mussten die Agenturen ihre Hosen herunterlassen und auch Modellfehler einräumen“, sagt Frank Cerveny. Inzwischen seien zwei Programmierfehler bekannt geworden, zuletzt jetzt am 4. September 2008, mit ähnlichen Konsequenzen. Cerveny: „Schuster bleib bei Deinen Leisten – sollen sich die Ratingagenturen auf das originäre Credit-Risiko konzentrieren?“
Vieles sei mit der heißen Nadel gestrickt. Möglicherweise sei auch vieles überfrachtet worden, so dass der Investor den Wald vor Bäumen nicht mehr sah. Neue Strukturen seien zurzeit kaum zu raten, da die Modelle neu kalibriert werden müssten. „Im Grunde genommen geht es bei den Ratingagenturen drunter und drüber“, warnt Cerveny. „Es werden Leute entlassen und die Boni werden auch herunter gehen, insofern sinkt das Incentive.“
Cerveny kommt auf die Konsultationspapiere der Europäischen Kommission zu sprechen, für die sich Charlie McCreevy stark gemacht habe. Auch die US SEC habe sich wieder zu den Ratingagenturen geäußert. Insbesondere gehe es um Transparenz und die Trennung von Consultingaufgaben. „Es mache sicherlich Sinn, auch die Investoren zu zwingen, ihre eigenen Analysekapazitäten auszudehnen“, kommentiert Cerveny die Aktivitäten der Gesetzgeber.
Cerveny spricht auch die Assetmanager an, die Strukturen verwalteten . Investoren haben es vermieden, ausreichend in Analysekapazitäten und Datenbanken zu investieren. Hier habe man zuviel binär agiert, indem nur Rating und Spread betrachtet worden sei. Es gehe um Infrastruktur, ausreichende Personalausstattung und – last not least – um Gehälter. Die Salesforce vertrete den Hit-and-run Gedanken und verdiene am meisten. Erst am Ende der Nahrungskette finde sich die Analyse. „Hier muss man umdenken“, so Cerveny.
„Prognosen sind immer schwierig, vor allem, wenn sie in die Zukunft gehen“, zitiert König einen alten Lehrer. Stabilität der Ergebnisse setze Stabilität in den Annahmen und Voraussetzungen voraus. Wenn die Anlagevorschriften nicht die Beachtung von Ratings erzwingen würden, bräuchte man sich mit der Prognosegenauigkeit der Ratings nicht in dem Maße zu beschäftigen, bemerkt König. Rating sei für manche Investoren „die“ wesentliche Variable für Anlageentscheidungen. Mit diesen und weiteren – insgesamt 12 – Thesen facht König die Diskussion an.

Halo Effects of CRAs�?? Authorizations

Providing rating services for two decades now, Feri EuroRating Services‘ corporate identity is the one of a truly independent, neutral rating agency focusing various niches in the rating market, with only a few overlaps with services of the US CRAs. „Our rating products never caused any market turmoil or crises, on the contrary: Since many years our ratings help investors to take better informed decisions and to make prudent investments. Nevertheless, the planned regulation of rating agency, which is focused on CRAs, will have effects on our business because it sets standards on how rating agencies in general should be organized and how they should operate.“ That is why they draw the European Union’s attention to their comments on the draft Directive / Regulation on „Authorisation, Operation and Supervision of Credit Rating Agencies (CRAs)“.
„As is proven by the history of our rating agency, it is possible to gain market acceptance by means of supreme quality of services alone. Better judgment and reliable investment advice are always welcomed by market participants. There is no need for a formal recognition process in the first place. Nevertheless, we fear that the authorization process designed by the Commission would have an effect on competition among rating agencies“, writes Feri.
The planned authorization, which shall be valid for the entire territory of the Community, will undoubtedly help authorized rating agencies. It helps mainly the US rating agencies to reestablish confidence in their services, since the need for change in their systems and processes is obvious. As obviously as an authorization helps authorized rating agencies it will hurt those who will get rejected, goes the argument of Feri. It will be understood by market participants that authorized rating agencies comply with the conditions for authorization, while others do not. „This would be no problem if rating agencies would compete only as credit rating agencies“, says Feri.
The reality is different, warns Feri: Some CRAs provide rating services also on mutual funds, insurance policies or similar rating niches. „We assume that the current proposal would not allow other rating agencies to get an authorization if they are not operating as credit rating agencies.“ Therefore they could meet all requirements for being recognized with the exception of not being a credit rating agency, but a real estate rating agency, mutual fund rating agency, insurance rating agency or whatever their investment rating focus is.
„Especially for those rating agencies serving retail customers we foresee a detrimental effect on competition, because it would be very difficult to explain to retail investors why one e. g. US rating agency got an official authorization while another European rating agency got none, although both are offering the retail investor guidance on his mutual fund investments by means of mutual fund ratings“, say Feri EuroRating Services AG’s board members Dr. Helmut Knepel and Dr. Eberhard Weiß „It is unlikely that everybody will understand the nuances of the law and differentiate among rating agencies accordingly.“
They believe that there will be a „halo effect“ of the authorization for credit ratings on other areas of the rating business, such as mutual fund ratings. According to their analysis of the market situation, authorized rating agencies will have fewer problems to convince investors on their compliance with minimum requirements and quality standards than unauthorized rating agencies. Since the Directive aims mainly at a segment of the rating market which is largely dominated by a US duopoly, the contradictory outcome of the law could be in the long run that the US duopoly will be even better entrenched in the future, leaving even less room for competition in other areas of competence in the rating business.
„We therefore recommend taking the authorization of other rating agencies into consideration, which were not causing the market turmoil which gave the reason for the new legislation.“ Also rating agencies that served the markets without any complaints of their clients and are therefore not subject to any project for regulating them should have the chance to get authorized and get public approval if they meet all requirements. The scope of the Directive should be extended to all rating agencies serving issuers, investors and other market participants in making better informed financial decisions.

Standard & Poor’s and Moody’s Investors Service objected to European Union rules on conflicts of interest and disclosure of credit ratings in response to the past year’s market turmoil, reports Bloomberg’s John Rega. „S&P and Moody’s told the European Commission, the EU executive arm in Brussels, in statements today that detailed regulations may interfere with credit ratings. Instead, they urged the EU to rely on an international code of conduct.“
Financial Services Commissioner Charlie McCreevy is reportedly considering measures including special labels for structured- finance products, such as the mortgage-backed securities that helped spread losses on U.S. home loans. He’s also weighing requirements for rating firms to rotate staff and take other steps to safeguard analysts from influence by rated companies.
„While Moody’s does not object to enhanced regulatory oversight in the EU, we, like many market participants, believe changes to the commission’s proposal are needed to ensure it does not impair the efficient workings of the European and global capital markets,“ the company said in a statement.
The firms said they expect they will have to accept some formal supervision by registering with authorities. That’s a central point in the plan by the commission and the French government to step up oversight of credit ratings in response to the financial-market disruption of the past year, in which U.S. subprime mortgage defaults set off a rout in related securities that led to more than $500 billion of bank losses and writedowns.
„Standard & Poor’s recognizes the commission’s desire for additional external oversight of rating agencies and shares the commission’s aim of supporting the quality and transparency of ratings opinions,“ the company said in a statement. „The commission can best meet its objectives through a globally consistent solution“ based on the code of conduct written by regulators at the International Organization of Securities Commissions.
S&P is a unit of McGraw-Hill Cos. of New York. Moody’s is a unit of New York-based Moody’s Corp. The Securities Industry and Financial Markets Association backed the rating companies today, saying the commission’s July 31 proposals are too burdensome and may undermine confidence by giving authorities power to interfere with ratings.
„Imposing a prescriptive regime of the kind proposed“ won’t help ensure the independence, objectivity and quality of ratings, said Deborah Cunningham, senior portfolio manager for money markets and municipal bonds at Federated Investors Inc. and co-head of a Sifma task force on the issue.
The commission will analyze submissions to its consultation, which concluded Sept. 5, before shaping a formal legislative proposal in October, McCreevy’s spokesman, Oliver Drewes, said by telephone to John Rega. EU governments and the European Parliament would have to agree, in order to enact any measure. In a Bloomberg Television interview Sept. 5, McCreevy said the credit-rating companies must be „lightly regulated,“ and he will do what’s best even if companies disagree.

Marketingkonzepte für Einzelhandelsimmobilien

In der Immobilienwirtschaft wird Marketing häufig mit Kommunikationspolitik (Public Relations, Werbung, Public Affairs) assoziiert, berichtet Elisabeth Kammermeier, Geschäftsführerin der Activ Consult Real Estate GmbH in ihrem Vortrag beim Europäischen Finanz Forum in Frankfurt am Main. „Wir verstehen Marketing ganzheitlich als ein Konzept zur marktorientierten Unternehmensführung.“
Der deutsche Einzelhandel umfasst rund 420.000 Unternehmen mit 2,7 Millionen Beschäftigten. Einzelhandelsimmobilien haben ein starkes ökonomisches Gewicht für die Entwicklung der Städte. Außerdem wachse der Anspruch an Erlebnisqualität von Orten und Räumen, berichtet Kammermeier. Das Wachstum deutscher Shoppingcenter sei ungebremst, bis 2010 würden rund 1 Mio. qm neue Verkaufsflächen entstehen. Für 2008 seien in Deutschland 15 neue Einkaufszentren in Innenstädten geplant, zitiert Kammermeier aus dem Shoppingcenter-Report 2008/2009 des EHI Retail Institute /GCSC.
Vorrangig interessieren sich institutionelle Anleger für Gewerbeimmobilien, die dazu eine langfrstige Anlagepolitik verfolgen. Immobilien seien nicht mehr per se immobil, da eine Mehrzahl von Instrumenten zur Verfügung stehen, um in Immobilien zu investieren. Verlässlich Bewertungen sind ein Schlüssel dafür, Immobilien als Assetklasse zu erschließen. Der Leitfaden der European Group of Valuers Association (ETGoVA) hat sich für Gutachter in Europa etabliert. Er umfasst ex- und interne Faktoren der Kriteriengruppen Markt, Standort, Objekt und Kapitalfluss.
Marktsituation, Markterfordernisse, Altersstruktur, Sortiment, Differenzierung, Wachstumsmarkt, Leistungssituation, Marktanteil und vieles mehr sind Einflussfaktoren und Ansatzpunkte für ein umfassendes Rating von Einzelhandelsimmobilien. Das veränderte Konsumverhalten erfordere ein professionelles Immobilienmarketing, denn Kaufentscheidungen ingen zunehmend ab von Inhalten, Emotionen, ethischen Überlegungen. Immobilienprojekte müssen sich daher behaupten durch konzeptionelle Passgenauigkeit und umfangreichen Zusatznutzen.
Die Wertschöpfung werde vorrangig durch Produktabsatz und/oder Umsatz generiert, die Marketingstrategie biete hier einen entscheidenden Hebel, argumentiert Kammermeier: Sie trennt die Spreu vom Weizen. Das Konsumentenverhalten werde von Emotionen bestimmt, die sich auf einer Wertewelt gründen.
„Die Immobilienwirtschaft habe sich nie richtig viel Gedanken über Marketing gemacht“, heißt Kammermeier die Immobilienwirtschaft im 21. Jahrhundert willkommen. Sie gibt den Opernturm als Beispiel: Es werde zum schönsten Gebäude Frankfurts, in dem „man einfach sitzen wolle“. Emotionale Wertewelten müssten angesprochen werden. Die Mall of America, Bloomington, Minnesota, USA, sei ein Beispiel dafür, wie in einer Mall „alles“ untergebracht werden konnte.
Fehlende emotionale Ansprache führe zu verwaisten Food & Beverage-Courts. Kammermeier gibt aus ihrem Erfahrungsfundus eine Reihe von Beispielen mit vielen Details, die ihre These belegen, welche zentrale Bedeutung das Marketing für Einzelhandelsimmobilien besitzt: Materialien, Assoziationen, Perspektiven usw. Kammermeier illustriert z. B. am Vasco da Gama-Center in Lissabon, wie die Schifffahrt ein Leitthema für einen Shoppingcenter sein könne und damit einen Bezug zur Kultur der Stadt und zu den Menschen schaffe.

DBRS Calls For Harmonization

In response to the request for comments made by the Commission regarding its Regulatory Proposals for CRAs, DBRS has submitted a letter to the Commission providing its views. The Regulatory Proposals for CRAs are intended to implement additional oversight and monitoring of CRAs in Europe through a broad regulatory framework requiring registration of CRAs and imposing an extensive array of requirements and limitations regarding the conduct of its business. These requirements relate to organizational processes and policies, corporate governance, conflicts of interest, rating methodologies, disclosure and transparency, employees and record-keeping. A second proposal for „tackling the problem of excessive reliance on ratings“ was also released for comment that reviews possible approaches to reduce such reliance including the elimination of references to ratings in existing EU legislation.
„DBRS does not object in principle to the introduction of an EU registration and supervision framework“, the Canadian rating agency with international ambitions says in a press release. „However, DBRS submits that any regulatory framework should be harmonized with other international regulatory frameworks for CRAs that promote high standards of independence, integrity and transparency such as the IOSCO Code of Conduct and the U.S. Securities and Exchange Commission’s regulatory regime for Nationally Recognized and Statistical Rating Organizations (NRSROs).“
Moreover, according to DBRS, the regulatory framework should permit the operation of CRAs of varying size and business models. „Further, DBRS notes that the Commission’s proposal to bolster CRA oversight and investor confidence in ratings is fundamentally at odds with its proposal to consider reducing reliance on ratings“, warns DBRS.
DBRS comments centre on the lack of global harmonization and inconsistency with best practices in other international markets. In addition, many of the proposed requirements are disproportionately burdensome to the objectives they seek to achieve, says DBRS, create unnecessary barriers to entry in the EU market and have other potential anti-competitive consequences.

No Turmoils by European Ratings

Schadenbelastung aus Hurrikan „Gustav“

Wilhelm Zeller, der Vorstandsvorsitzende der Hannover Rück, machte anlässlich eines Pressefrühstücks in Monte Carlo erste Angaben zur Schadenbelastung aus dem Hurrikan ,Gustav‘, der Ende August über den Golf von Mexiko und Louisiana fegte. Der Wirbelsturm verursachte nach Schätzungen einschlägiger internationaler Modellierungsagenturen einen versicherten Schaden zwischen 1,5 und 8 Mrd. USD. Davon entfallen rund 1,5 bis 4 Mrd. USD auf das sogenannte Offshore-Geschäft, also die Bohrinseln und Ölplattformen im Golf, sowie bis zu 4 Mrd. USD auf das Onshore-Geschäft: die versicherten Sachschäden an Land. Die genaue Höhe des Schadens dürfte erst in einigen Wochen verlässlich abschätzbar sein.
Die Hannover Rück geht vor diesem Hintergrund von einer Netto-Schadenbelastung von unter 100 Mio. EUR aus. „Wir liegen mit dieser Schadenbelastung immer noch deutlich innerhalb unseres Großschadenbudgets“, erklärte Zeller. Die Hannover Rück veranschlagt hierfür 10 % ihrer erwarteten Nettoprämie in der Schaden-Rückversicherung, also rund 400 Mio. EUR für 2008.
Die Rückversicherungsgruppe aus Hannover betreibt alle Sparten der Schaden- und Personen-Rückversicherung und unterhält Rückversicherungs¬beziehungen mit über 5.000 Versicherungs-gesellschaften in rund 150 Ländern. Ihre weltweite Infrastruktur besteht aus über 100 Tochter- und Beteiligungsgesellschaften, Nieder¬lassungen und Repräsen¬tanzen in rund 20 Ländern mit ca. 1.800 Mitarbeitern. Das Deutschland-Geschäft der Gruppe wird von der Tochtergesellschaft E+S Rück betrieben. Die für die Versicherungswirtschaft wichtigen Ratingagenturen haben sowohl Hannover Rück als auch E+S Rück sehr gute Finanzkraft-Bewertungen zuerkannt (Standard & Poor’s AA- „Very Strong“; A.M. Best A „Excellent“).

Rückkehr der Geopolitik

Die aktuellen Ereignisse im Kaukasus und in Afghanistan rücken außenpolitische Fragen stärker ins Bewusstsein der Öffentlichkeit. Deutsche Soldaten sterben außerhalb Europas in Konflikten, die fern von einer friedlichen Lösung sind. „In den Medien werden diese Konflikte häufig mit untauglichen Kategorien bewertet. Dabei lohnt es sich durch die Brille der wichtigsten Akteure zu schauen“, schreibt Udo Schäfer, Referent im Landtag von Baden-Württemberg, in einem Leserbrief an die FAZ, der dort auszugsweise abgedruckt wurde (FAZ vom 26. 8 .2008). In den USA prophezeit Robert Kagan, Mitbegründer der neokonservativen Denkfabrik Project for the New American Century (PNAC) und Berater von McCain, einen Wettkampf zwischen Demokratien und Autokratien. Kagan sieht die russische Führung im Denken des 19. Jahrhunderts verhaftet:
„Für den Autokraten ist die Welt ein beängstigender Ort. Der liberale Westen wird als Hegemon der Welt empfunden �?� Wir im Westen glauben an den Triumph des Rechts und des Guten. So blicken wir auf die Ukraine und Georgien.“ Kagan, Richard Perle und die deutschen Atlantiker, zu denen auch der außenpolitische Sprecher der CDU/CSU-Bundestagsfraktion Eckart von Klaeden gehört, wollen eine globale Führerschaft der USA, weil eine multipolare Welt für alle gefährlicher sei. Wladimir Putin sagte hingegen auf der 43. Münchner Sicherheitskonferenz: „Ich denke, dass für die heutige Welt das monopolare Modell nicht nur ungeeignet, sondern überhaupt unmöglich ist.“ Und es bestehe kein Zweifel, „dass das wirtschaftliche Potenzial neuer Wachstumszentren auf der Welt unausweichlich auch in politischen Einfluss umschlägt und die Multipolarität stärkt.“ Eine Position, die auch von der chinesischen Führung geteilt wird, schreibt Schäfer.
Putin nehme die amerikanische Weltmacht als Hobbesschen Leviathan wahr: „Es ist die Welt eines einzigen Hausherrn, eines Souveräns. Und das ist am Ende nicht nur tödlich für alle, die sich innerhalb des Systems befinden, sondern auch für den Souverän selbst, weil es ihn von innen zerstört.“ Während US-Außenministerin Condoleezza Rice überzeugt ist, dass „die Wirklichkeit ist, dass ‚Multipolarität‘ niemals eine vereinigende Idee oder eine Vision gewesen ist. Sie war ein notwendiges Übel, das den Krieg fernhielt, aber nicht zum Triumph des Friedens führte. Multipolarität ist eine Theorie der Rivalität, von konkurrierenden Interessen – und schlimmstenfalls – von konkurrierenden Werten.“ Russland orientiert sich historisch an der Heiligen Allianz, schreibt Schäfer, eine von Zar Alexander I. angeregte Absichtserklärung der Monarchen Österreichs, Preußens und Russlands, die Prinzipien der christlichen Religion (Gerechtigkeit, Liebe und Frieden) zur Grundlage bei der Wiederherstellung der durch die Napoleonischen Kriege zerstörten politischen Ordnung im kontinentalen Europa zu machen.
Die russische „Friedensmission“ in Georgien erscheint so in einem neuen Licht. Darauf weist Schäfer hin und zitiert eine Erkenntnis von Henry Kissinger: „Sobald eine Macht die internationale Ordnung oder die Art ihrer Legitimität ablehnt, werden die Beziehungen zwischen ihr und den anderen Mächten revolutionär.“ Lässt sich auch auf die Beziehungen Russlands zum Westen anwenden. Kissinger spricht in seinem Werk „Das Gleichgewicht der Großmächte“ den jeweiligen Staaten das Recht zu, gemäß ihrer inneren Struktur zu entscheiden, was richtig ist und was durch ihre Kraft und geographische Lage möglich ist. Laut Robert Kagan sind die USA ein Koloss mit einem Gewissen: „Sie sind nicht das Frankreich Ludwig XIV. oder das England Georg III �?� Amerikaner nehmen für sich nicht das Recht des Stärkeren in Anspruch �?� Die Amerikaner haben die Grundsätze der alten Ordnung Europas nicht übernommen, eine machiavellistische Perspektive ist ihnen fremd.“
„Um die wütende russische Reaktion in der Kaukasuskrise zu verstehen,“ rät Schäfer, „muss man die geopolitische Lage mindestens des Mittleren Ostens betrachten. In westlichen Medien wurde offen über die Möglichkeit diskutiert, von Georgien aus einen militärischen Schlag gegen den Iran zu führen. Der russische Angriff auf militärische Stützpunkte der georgischen Armee, macht deutlich, dass Russland keinen militärischen Alleingang des Westens gegen den Iran dulden wird, der in der russischen Einflusssphäre stattfindet.“
Russische Energiekonzerne wollen ihrerseits iranisches Gas und Öl durch ihr Leitungsnetz zahlungskräftigen Kunden anbieten. „Das geht aus russischer Sicht nur,“ so Schäfer, „wenn der Konflikt des Westens mit dem Iran zumindest dauerhaft entschärft und die Zugangswege durch Georgien für zukünftige Pipelines von Russland in den Iran offen bleiben. Mit einer georgischen Regierung, die sich von amerikanischen Militärberatern unterstützen lässt, ist das nicht denkbar.“
Die russische Führung habe nicht vergessen, dass vom Angriff gegen Jugoslawien 1999, dem laufenden Irak-Krieg, bis zur Unabhängigkeit Kosovos eigentlich russische geopolitische Interessen von den Westmächten nicht berücksichtigt wurden. Schäfer: „Die deutschen Atlantiker hingegen unterschätzen die russische Furcht vor der Einkreisung durch den Westen. Russland, die Türkei und der Iran werden auch dann noch mit den Völkern des Kaukasus als Nachbarn zusammenleben müssen, wenn die Westmächte wegen der zur Neige gehenden Energierohstoffe langsam das Interesse am Kaukasus verlieren und sich zurückziehen.“ Die Türkei könne ihre hohe Abhängigkeit von Energieimporten aus Russland mittelfristig nur durch entsprechende Importe aus dem Iran vermindern. „Einer der Gründe, weswegen die Türkei sogar mit dem verfeindeten Armenien redet. Die Sanktionen gegen den Iran stärken deshalb die geopolitische Position Russlands. Eine erfolgreiche Gleichgewichtspolitik im Kaukasus lässt sich nur implementieren, wenn es gelingt, Russland als Großmacht durch konstruktive Beziehungen zu den Mittelmächten Türkei und Iran in einen größeren politischen Zusammenhang einzubetten“, so Schäfer.
Das Nato-Mitglied Türkei werde von den geopolitischen Akteuren der Region als wichtiger strategischer Partner respektiert und sei deshalb als Vermittler nicht nur im Kaukasus unverzichtbar. Wenn die USA den regionalen Mittelmächten weiterhin eine eigenständige Mitgestaltungsmöglichkeit verweigerten, werde eine direkte Konfrontation zwischen Russland und den USA immer wahrscheinlicher, vielleicht demnächst in der Ukraine, spekuliert Schäfer.

Scope on CRAs�?? Authorizations

The German rating agency Scope Analysis GmbH (www.scope.de), Berlin, comments on the draft Regulation / Directive „Authorizations, Operation and Supervision of Credit Rating Agencies (CRAs)“ to DG Internal Market and Services. Founded in 2000, Scope Analysis soon became one of the leading rating agencies in the sectors of closed-end funds and open-end real estate funds, certificates and alternative investments. More than 800 mainly institutional investors subscribe to our services. „Our ratings affect investment decisions of thousands of private investors every day. Our team of 40 employees is trained to ensure that our ratings are reliable and accurate pieces of information. High standards of quality in the ratings and transparency of our rating agency are cornerstones of our success story“, writes Scope Analysis.
„Scope Analysis meets substantive requirements which cover issues related to the organizational structure and internal governance of our rating agency, the avoidance and management of conflicts of interest, the quality of ratings and transparency to our subscribers“, writes Scope Analysis‘ CEO Florian Schoeller to Brussels, and goes on: „The draft Directive / Regulation in its present form does not provide for an authorization and supervision process which is adapted to the specificities of the rating activities of the various rating agencies active in the EU, since it does not take into account the different nature of the relationship to issuers of investor-driven rating agencies like ours“, and provides various examples.
Her claims that his rating agency is not mandated for investment ratings by any issuer and therefore making proposals or recommendations, either formal or informal, regarding the design of a finance instrument is none of Scope Analysis‘ business. „In our case,“ he writes, „rotation arrangements to be put in place for analysts and persons approving ratings to avoid that they develop long lasting relationships with the same rated entities, would not add to the quality, accuracy, thoroughness and integrity of their work. We believe that long-lasting experience and in-depth knowledge of issuers rated does not compromise the independence of our analysts, but allow us to as-sure that methodologies and models used by our rating agency are regularly re-viewed in order to be able to properly reflect the changing conditions in the underlying asset markets.“
The rating activity that is used for regulatory purposes e.g. risk assessment by financial institutions is concentrated among a very small number of players in the EU. „The draft Directive / Regulation is dangerously limited in its scope to this handful of players providing credit rating services internationally, with strongholds in the USA.“
Scope Analysis comments on the likely compliance costs, the likely effect on competition and other impacts, costs and benefits. „Given the extremely short timeframe to provide you with your comments, we have to limit our remarks to the following, notwithstanding further objection if we are allowed to go into detail: We believe that compliance costs would be limited, since our organization al-ready meets very high standards and requirements, which are really at the heart of our credibility and standing among investors and the public. Our biggest concerns are about the effect on competition, since in its current form the draft Directive / Regulation would not allow other rating agencies but credit rating agencies to get authorized. This would clearly provide a competitive advantage to the US rating agencies, since they serve like superstores different markets with a wide range of products. Their authorization in one product group, credit ratings, would transmit to other product groups like mutual fund ratings. Once provided with a special, authorized status, they could build on this recognition by making investors and the public believe that they are not only closely monitored, but that they merit an official status and therefore deserve their special attention.“
According to Scope Analysis, if CRAs which contributed to the recent market turmoil by underestimating the credit risk of structured credit products get authorization and recognition while others not involved in the crisis do not, the Directive / Regulation would ironically reward their failures with a pole position in the market.
„The scope of the Directive / Regulation must be broadened to all rating services on financial instruments and products, so that any rating agency can, but does not need to register as an authorized rating agency. Authorization should be provided to any rating agency which submits itself to supervision by the authorities and complies with all rules and standards. In addition, a proportionality rule should be included in the Directive / Regulation to assure that smaller rating agencies are recognized on a comparable basis.“
